No 1st Amendment Right to Take Cellphone Videos of Police

A federal judge in Philadelphia has ruled that citizens don’t have a First Amendment right to take cellphone videos of police unless they are challenging or criticizing the police conduct.
 The judge did allow that they had a 4th Amendment claim, just not one under the 1st Amendment since they weren't expressing anything to the police by taking the video.
